Eintracht Frankfurt boss Markus Krösche was furious with the refereeing team over the decision to show Arthur Theate a second yellow card in his side’s 1-1 draw with Union Berlin in the Bundesliga on Sunday.

Krösche insisted that he believed Theate was fouled before the challenge on Andras Schäfer that led to the dismissal, and made it clear that Eintracht would appeal the decision.

However, it’s now clear that their attempts to overturn Theate’s one-game suspension were unsuccessful and the player will therefore not be available for Saturday’s Bundesliga match against VfL Bochum.

“This is a factual, generally binding decision. It would only be different in the case of an obvious error, i.e. a decision that is undoubtedly wrong,” said the chairman of the DFB Sports Court Stephan Oberholz.

“There are no indications of a misjudgement, at least not one that is obvious and could break the binding effect of the factual decision.”

Theate will be available for Eintracht’s match against Gladbach in the DFB-Pokal on Wednesday, as the suspension only applies to the Bundesliga.
